Legal Notice & Terms of Use
All materials on this site — photos, videos and texts — are protected as works of authorship under the laws of the Russian Federation.
Copyright & ownership
All photo, video and text materials on this site are works of authorship (works of science, literature and art) protected by copyright and belong to their author. Copyright in a work arises the moment it is fixed in a material form and does not require registration.
No use without consent
Any reproduction, distribution, copying, posting on other sites or in social media, modification, or creation of derivative works without the rights holder's prior written consent is not permitted (Art. 1229 of the Civil Code). The rights holder may permit or prohibit the use of their work; the absence of a prohibition is not deemed consent. A watermark on a photo indicates authorship and is not a license to use it.
Limited cases of use without consent
The Civil Code provides for a narrow set of cases in which a work may be used without my permission and without payment. In quotation, use as educational illustration, and in reviews of current events — including by means of photography and cinematography — a work may be used without my permission, but only with mandatory indication of my name as the author and a link to the original source: to this site and to the specific item (Art. 1274 of the Civil Code). Personal, non-commercial use by an individual, when necessary, is separately allowed (Art. 1273 of the Civil Code), in strictly limited scope and with carve-outs. Indication of the author and a link by themselves do not create a license — they are only a mandatory condition for applying the exception. The exceptions do not cover commercial use, do not extend to cases that harm the ordinary exploitation of the work or my legitimate interests, and do not affect my moral rights (including the right to the inviolability of the work). In all other cases, including commercial use, use is permitted only with my prior written consent (see 'No use without consent').
Legal basis
Civil Code of the Russian Federation, Part Four, Section VII — “Rights in the results of intellectual activity and means of individualization”, in particular Art. 1229 (“Exclusive right”) and Art. 1266 (“Right to the inviolability of a work and protection against distortion”); remedies for infringed rights and liability for their violation are also governed by the Civil Code. Personal data, where present in the materials, is processed in accordance with Federal Law No. 152-FZ of 27.07.2006 “On Personal Data”.
